The sellers want the exposure benefits of TMLS, the Triangle Multiple Listing Service, and are willing to show their property to unrepresented buyers, answer questions from buyers agents, negotiate their own sales contract, and handle their own preparations for closing. Sellers agree that they do not need or require the full range of services offered by mainstream brokers.
The sellers understand the role that the Centralized Showing Service (showings.com) plays in arranging showings in the area and understands that they may receive calls from this service to arrange showings for potential buyers working with a broker or agent.
The sellers are choosing the flat fee, limited service offered by My Listing Services with the following understandings:
- A broker MAY lawfully limit, by contract, the services provided to a client.
- A broker MAY NOT contractually limit or waive duties imposed by statute or by the North Carolina Real Estate Commission for those services being offered in a limited service contract.
- This contract limits agency duties under the common law of agency to only those services covered under this limited service contract. The limited service listing contract calls for the Listing Broker to place a sign on the Seller's property and place the listing in the TMLS system. The seller is then responsible for any additional advertising, showing the property to unrepresented potential buyers, and working directly with buyers, selling agents, and closing agents (attorneys/paralegals) involved in the transaction.
My Listing Services will provide the general duty of skill, care, and diligence required at all times of a Listing Agent, but will not advertise the Seller's property, show the Seller's property, or negotiate offers on behalf of the Sellers for the scope of services offered in the limited service contract.
